The Effects Of The Claim Period Clause Under The Deposit Liability Insurance For Non-vessel Operating Common Carrier

 

Most of the non-vessel operating common carrier deposit liability insurance (hereinafter referred to as ‘NVOCC deposit liability insurance’) provides for a claim period in the insurance liability clause, which means that the claimant is obliged tosue the insured and obtain the effective judgment documents within the insurance period. The clause should be treated as null and voidfor exemptingthe insurer from main responsibility, increasing the liability of the claimant and excluding the main rights of the claimant in an inappropriate manner, that violates the principle of good faith.
