In order to thoroughly implement the guideline of the central government on supporting high-level reform and opening-up of the Pudong New Area to build it into the pioneer area for socialist modernization, the relevant opinions of the Supreme People's Court and the relevant plans of the Shanghai High People's Court, the Shanghai Maritime Court released the implementation opinions recently on supporting high-level reform and opening-up of the Pudong New Area and building it into the pioneer area for socialist modernization (hereinafter referred to as the “Implementation Opinions”).
The Implementation Opinions puts forward 4 general requirements, including strengthening political awareness with persistence in the right direction of work, enhancing the sense of responsibility and mission, meeting the judicial needs accurately and providing strong judicial support to the high-quality development of the pioneer area with adherence to righteousness and innovation.
The Implementation Opinions focuses on the construction opinions on Pudong pioneer area of the Central Committee of the Communist Party of China and the State Council and emphasize the strength of maritime adjudication function to improve high-level leading effect. From four aspects i.e., new distribution of judicial resources, advantages of cooperation and competition, new power on high quality development and new innovation progress, the Implementation Opinions puts forward proper judgement on shipping broker, maritime insurance, shipping financing, international shipping management and registration disputes. The Implementation Opinions also clarifies several judicial tasks ,including to strengthen the cooperation of four maritime courts in the Yangtze River Delta, to research on the international shipping registration in Yangshan port and coastal transportation of international ships, to combine itself with policies on clearance in special customs surveillance zone such as Yangshan Free Port and Lingang Special Area, to proper judge on disputes on maritime right of use, to improve the public interest litigation system of the ecology environment of the ocean, to support the green transportation development, to improve protection on crew legal rights and interests under health and emergency management, and to research on the application of shipping blockchain technology.
Also, in aspects of improving the business environment firmly, fairly and efficiently and creating a positive image of maritime justice across the world on the basis of institutional innovation, the Implementation Opinions makes comprehensive arrangements for the Shanghai Maritime Court, located in Pudong pioneer area, to leverage the leading role in maritime justice.
The Implementation Opinions is the institutionalization and institutionalization of national strategies’ achievements served by the Shanghai maritime court. It’s also the new systematic strength formed by goal-oriented ,demand-oriented and problem-oriented motion. What is more, it’s the specific measures to revitalize market confidence and stimulate market vitality.
