Speed! The judicial arrest of a foreign ship is done in only 3 hours to prevent it from leaving China during the National Day holiday


In order to prevent a foreign ship from taking the opportunity of the National Day holiday to leave the country, Shanghai Maritime Court made the pre-litigation ship arrest very efficiently.


On the last working day just before the holiday, it took the court only 3 hours to complete a series of activities including legal examination, application acceptance, document scan, ruling issuance and ship arrest order service. Such a quick move is highly praised by the applicant.


At about 22:30 on September 28, 2018, the Russian ship "AMUR" collided in the waters near the Waigaoqiao of the Yangtze River estuary with ship "Xinlinhai 6" of Jiangsu Linhai Marine Shipping Co., Ltd.  (hereinafter referred to as Linhai Company), causing severe damage to the latter.


"The National Day holiday is coming. We are very worried that the ship ‘AMUR’ will leave the country during the festival. How do I apply for the arrest of the ship?” On the morning of September 30, Shanghai Maritime Court received a telephone consultation from Linhai Company.


After receiving the call, the handling judge immediately proceeded to guide Linhai Company to prepare the application materials required for a pre-litigation arrest.


At 14 o'clock in the afternoon, after receiving the complete set of materials including the arrest application and the guarantee submitted by Linhai Company, the handling judges immediately began the legal examination and the application acceptance registration, and quickly issued a ruling and a ship arrest order. And the enforcement judges rushed to serve the order right after receiving the document.


At 17 o'clock in the afternoon, the ship "AMUR" was successfully arrested.
