Maritime Court builds a new model of "Smart Enforcement" to crack
"Difficulties in Enforcement"
"Difficulties
in Enforcement" has always been a difficult issue followed by all walks of
life. To solve the maritime "Difficulties in Enforcement", Shanghai
Maritime Court has deepened the integration of information technology and
maritime enforcement in the exploration of accelerating the construction of a
smart maritime court. It has developed a ship data analysis system to track and position global ships through
big data collection and intelligent analysis, in the process of vigorously
promoting the judicial auction of ship networks, continuously standardizing and
improving the auction process, and has thus improved the efficiency of maritime
case enforcement.
Big
data collection and intelligent analysis: tracking and positioning global ships
The
“owner” privately transferred the Italian ship MV "PRIMROSE" to
overseas buyers, and then owed more than 400,000 yuan
to the vessel's staff and refused to pay. The nine crew members brought the
case to Shanghai Maritime Court but failed to provide the accurate information
about the ship, so the ship could not be arrested at first and thereby they
could not exercise the maritime liens. Fortunately, Shanghai Maritime Court, through
the ship data analysis system, fully docked the global international ship
registration information, thus quickly found out the real ship owner involved
in the case, and efficiently arrested the ship based on legal procedures. The
legitimate rights and interests of the parties were protected timely and
effectively.
Online
Judicial Auction of Ships: Records are constantly refreshed
In
January 2017, the Panamanian ship "MAHONI" was successfully
auctioned. This is the first foreign ship that has been successfully auctioned
on the Internet platform by a Chinese court.
In
January 2017, the ship “MING DE 152” was successfully auctioned for RMB 96
million, which was the historical high of the online judicial auction sale
prices of ships at that time.
In
August 2017, the ship "HONG XIANG 59" was successfully auctioned,
attracting a total of 13,061 onlookers. This is the first ship auction of
Shanghai Maritime Court attracting more than 10,000 onlookers.
According
to the statistics, since 2014, Shanghai Maritime Court has successfully
auctioned 36 vessels through Taobao and other online
bidding platforms, with a premium rate of up to 194.70%. The auction turnover
totaled RMB 476 million, and the auction turnover rate and average premium rate
were both higher than those in the traditional way of auction. Tremendously, the
transaction cost of the bidders is saved, and the enforcement efficiency is
improved.
