Shanghai found the first national
maritime court practice base
The opening
ceremony of Smart Maritime Court (Shanghai) Practice Base, China's first court
practice base, was held on June 28.
Shen Deyong, Party deputy secretary and executive vice president
of the Supreme People's Court (SPC), attended and addressed the opening
ceremony.
Shen
stressed that we should keep up with the times and embrace the trends in modern
science and technology, promote the innovation of maritime judicial system and
the breadth and depth of maritime judicial practice in serving economic and
social development.
The practice
base, he said, is the first of its kind in China that has been approved by the
SPC. By means of the Internet, business networks, local area networks, and
maritime professional networks, the base will extensively collect data relating
to the maritime trials, including those of ships, cargoes, marine environment,
weather conditions and crew information, finding the in-depth potential value
of massive data and applying them to maritime judicial practice.
During his
speech, Shen stressed three points for the
construction of the practice base, including:
First, the
establishment of the practice base should be committed to leading the maritime
judiciary's direction of development. We should focus on collecting the
information as regards to the national maritime cases and referee documents,
gathering and analyzing the judicial data, thus contributing China's wisdom and
strength to the improvement of the international law of the sea. We should
strengthen data sharing on the maritime information application system with
relevant maritime departments; enhance the upgrading of maritime judicial services
to meet the demands of both the Chinese and the foreign clients.
Second, the
practice base should be established in line with the concept of prior planning
and innovative development. We should formulate a development plan which both
accords with the current needs and advances moderately; pursue inheritance,
increment, and sustainable and integrated development; make full use of the
resources from the sub-platform of China Maritime Trial System, China
Foreign-related Commercial Maritime Trial network, platform of Maritime Trial
network and other existing information construction results; comprehensively
consider the common needs of national maritime court in trial and execution,
litigation services and judicial management; adhere to unified leadership, unified
planning, unified standards, and strive to promote new development model of the
"Internet + maritime trial".
Third, the
practice base construction should be committed to creating a "model"
for the smart maritime court. We should dare to be the pioneer in establishing
the court, and have courage to innovate and practice, and strive to create a
practical adapting method to the maritime judicial work. The top priority
should be given to a new database system that can be extended to national
maritime courts. Strict rules on open access and approval procedures should be
made to ensure simultaneous development and application of the practice base
construction and information security system. A new mechanism should be
developed while focusing on the formation of institutionalized and specialized
trial models, thus achieving modernization of the maritime trial system and
trial capacity.
Chen Yin,
secretary of the Politics and Law Committee of the CPC Shanghai Committee,
addressed the ceremony. Liu Guixiang, full-time
member of the SPC Judicial Committee, announced the decision of the
establishment of "Smart Maritime Court (Shanghai) Practice Base". Cui
Yadong, president of Shanghai High People's Court,
presided over the launching ceremony. Leading officials of relevant departments
of the SPC and police representatives of Shanghai municipal political and legal
departments attended the event.
