The Validity and Jurisdiction Determination of the "Submission to Court for Arbitration" Clause

The clause that stipulates "submission to court for arbitration" and clarifies the finality of the arbitration belongs to the arbitration clause, However, when the arbitration institution cannot be determined according to law such as the place of arbitration, such clause shall be invalid.

In the event of a dispute arising over a contract for the carriage of goods by sea which has not been actually performed, if the agreed place of departure and destination of carriage are not the domicile of the parties, the court of the domicile of the defendant shall have jurisdiction.
