Because of the carrier's own breach of the obligation of dispatch and cargo handling, COVID-19 and its prevention and control measures do not constitute the reasons for the exemption of the contract. However, if it objectively affects the adoption of derogation measures, the carrier's derogation obligations can be reduced accordingly.
