Review of Binding Force of Foreign Arbitral Awards

 

When reviewing the non-binding defense of the foreign arbitration awards submitted by the Respondent in accordance with Article 5(e) of the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards, it shall generally be determined that the award will be binding upon the parties once the award is made, unless the Respondent can submit sufficient and contrary evidence to prove it. The Respondent brought the lawsuit to the court of the place of arbitration, which is not enough to prove that the arbitral award does not come into effect.Translated by Han Yun Fei
