Examination of Applications for Property Preservation in Hong Kong Arbitration Proceedings

The case is the first in China to grant property preservation applications in Hong Kong arbitration proceedings under the Arbitration Preservation Arrangement. When examining the application for preservation submitted by the parties in Hong Kong arbitration proceedings, maritime court should first clarify whether the case falls within the jurisdiction of the maritime court, and then examine whether the subject of the application for preservation is qualified according to the double standard of "place of arbitration & specific administrative agency", and then examine whether the procedure of application for arbitration preservation by the applicant conforms to the provisions of law and judicial interpretations.（Translated by Zhu Zhangxi）
