Application of fine deposit in the deposit dispute of cruise charter party

If a deposit agreed and actually paid to ensure the set of follow-up cruise charter contract ,the contract of deposit established and effective. If the follow-up main contract not concluded for the items that cannot due to any party ,the fine deposit cannot be applied.
