The
adjudication rule of port operators claiming heavy rainfall exemption
Port
operators shall not invoke limitations of liability or exemptions clauses in
Maritime Law to exempt their liabilities arising from heavy rain. But they
should rely on force majeure regulations in civil law and combine the facts and
regulations to check the facts whether meet constitutive requirements of force
majeure or not. Whereas in the circumstance of heavy rainfall has been
predicted and the damage might have been avoided by reasonable measures, port
operators shall not claim exemption.
